These Terms of Service (“Terms”) govern your participation as a vendor (“Vendor”, “You”) on POKBON Marketplace (“Platform”, “We”, “Us”), owned and operated by POKBON IT Solutions. By registering and selling on our Platform, you agree to comply with these Terms.
1. Eligibility and Registration
- Vendors must provide accurate business details, including name, address, contact information, and (where applicable) business registration or tax identification.
- Vendors must be at least 18 years of age.
- All information provided must be true, accurate, and up to date.
2. Vendor Account
- Vendors are responsible for maintaining the confidentiality of their login credentials.
- Any activity performed under a Vendor account will be deemed the responsibility of the Vendor.
- We reserve the right to verify vendor identity and request additional documentation.
3. Product Listings
- Vendors must provide clear, accurate, and complete product information (titles, descriptions, prices, images, stock levels).
- Misrepresentation, false advertising, or misleading product information is strictly prohibited.
- Vendors may not list counterfeit, stolen, illegal, or restricted items (e.g., weapons, drugs, pirated content, adult material).
- POKBON Marketplace reserves the right to remove listings that violate policies or Ghanaian law.
4. Pricing and Payments
- Vendors set their own product prices.
- POKBON Marketplace may charge a commission, listing fee, or transaction fee as agreed upon during onboarding.
- Payments to Vendors will be processed via Mobile Money, Bank Transfer, or other approved channels, subject to our payment schedule.
- POKBON Marketplace may withhold or delay payments in cases of disputes, chargebacks, or suspected fraud.
5. Order Fulfillment and Delivery
- Vendors must process and ship orders promptly within the timeframe specified at listing.
- Vendors are responsible for ensuring proper packaging to avoid damage in transit.
- If using POKBON Marketplace’s logistics partners, Vendors must comply with applicable shipping rules and fees.
- Failure to fulfill orders may result in penalties, suspension, or account termination.
6. Returns, Refunds, and Cancellations
- Vendors must comply with POKBON Marketplace’s Return and Refund Policy.
- Vendors are responsible for handling defective, damaged, or misrepresented products.
- Refunds must be issued promptly when approved.
- Consistent disputes or poor customer experience may lead to account suspension.
7. Vendor Responsibilities
- Maintain active stock levels and promptly update unavailable products.
- Provide timely customer service and respond to buyer inquiries within 24–48 hours.
- Ensure all products comply with Ghanaian laws, safety regulations, and international trade rules (if imported).
- Refrain from engaging in fraudulent, unethical, or misleading practices.
8. Intellectual Property
- Vendors must only use content (product images, logos, descriptions) they own or are licensed to use.
- By listing products, Vendors grant POKBON Marketplace a non-exclusive, royalty-free license to use, display, and promote such content on the Platform and in marketing campaigns.
9. Prohibited Conduct
Vendors may not:
- Attempt to bypass the Platform by directing buyers to external sites or completing transactions outside the Platform.
- Manipulate product ratings, reviews, or feedback.
- Upload viruses, malware, or engage in fraudulent activity.
- Use POKBON Marketplace to engage in illegal business activities.
10. Dispute Resolution
- Disputes between Vendors and Customers will first be handled through POKBON Marketplace’s mediation process.
- Vendors must cooperate in good faith to resolve disputes.
- In unresolved cases, Ghanaian courts shall have jurisdiction.
11. Suspension and Termination
- POKBON Marketplace may suspend or terminate Vendor accounts without notice for violations of these Terms.
- Vendors may terminate their account with 14 days’ written notice, provided all pending orders and payments are resolved.
12. Limitation of Liability
- POKBON Marketplace is not liable for vendor errors, product defects, customer dissatisfaction, or business losses.
- Vendors agree to indemnify and hold harmless POKBON Marketplace from any claims arising from their products or business practices.
13. Governing Law
These Terms are governed by the laws of the Republic of Ghana.
